Senate immigration bill lurches forward

The "Comprehensive Immigration Bill" (S. 1348) got a show of support today.
By a 69 to 23 vote, the Senate voted to invoke cloture, which is the first
process in moving this beast forward.

It's worth noting that all of the senators who are running for President of
the United States demonstrated their cowardice and lack of leadership by
not voting. These Senators did the "duck and cover" routine to avoid
accountability in the face of this clunker of a bill:

As annoying as it may seem that these cowards didn't vote, there is a
silver lining to it -- all of them understand that the comprehensive
immigration bill is a hot potato that could cost them their chance to be
President. They all support amnesty and H-1B but they want to hide that
from the public. That's a sign that the pressure you are putting on our
ruling elite is being heard.

To research what's in the bill, be ready for some major headaches. Not only
is it humongous, it refers to other immigration laws. You will have to have
multiple documents in front of you to unravel what it is saying. One of the
documents you will want is another humongous regulation titled "IMMIGRATION
AND NATIONALITY ACT", which you can view here:

Just to show you how bad S1348 is, here is a sample:
SEC. 419. H-1B STREAMLINING AND SIMPLIFICATION
(a) H-1B Amendments.- Section 214(g) of the Immigration
and Nationality Act (8 U.S.C. 1184(g)) is amended-
(1) in paragraph (1) by deleting clauses (i) through (vii)
of subparagraph (A) and inserting in their place --
This is a very brief summary of some of the employment based visas embedded
within S1348. For the purposes of this newsletter only the employment based
visa sections of the bill are discussed:
o Hagel and Lieberman Bill (MicroLieBagel) -- It appears that the "Skil
Bill" was scrapped in favor of the Hagel/Lieberman bill. I'm not sure which
is worse, but either way there will be big increases in H-1B and employment
based green cards, and it creates the new F-4 that gives foreign students
an easy path to H-1B and green cards. To find out more about the

o H-1B and L-1 fraud protection -- some mostly worthless provisions that
will supposedly protect you from the flood of H-1Bs that will invade the
nation once the bill is passed. There may be remnants of the
Durbin/Grassley reform bill buried somewhere in here -- if you find them
let me know where.
o Y Visas -- Combines H-2A and H-2B visas. It allows for a tenfold increase
in the yearly cap from 66,000 to about 600,000 visas. These visas are for
unskilled workers, which means it can be used for anything that H-1B and
L-1 visas are not used for. In other words, if H-1B doesn't get you, the Y
visa will!
o Z-1 Visas -- Illegal aliens can get this visa to work in indentured
servitude until they are granted amnesty. Whenever you hear that the bill
isn't amnesty, think Z Visa!
Bet on there being lots of nasty surprises in this bill that I haven't
listed. As my headache subsides, you can look forward to further analysis
of the bill. In the meantime, you can gaze at this AILA analysis, but be
aware they are the immigration lawyers that lobbied for the bill:

Senate Votes to Consider Immigration Bill
WASHINGTON, May 21 (UPI) -- The Senate voted Monday to consider the U.S.
immigration reform bill but won`t take up the measure until after the
Memorial Day holiday.
The 69-23 vote to invoke cloture was a major advance for the bipartisan
measure, which would offer legal status to millions of illegal immigrants
currently in the Unites States, The New York Times reported. The Times said
nearly 20 Republicans voted 'yes,' while only a few Democrats voted 'no.'
Senate Majority Leader Harry Reid, D-Nev., said there is too much work to
be done to push the bill through this week.
Sen. Edward Kennedy, D-Mass., called it a prudent and much-needed
compromise to bring the borders under control.
'Our values are tarnished when we allow 12 million human beings to live in
the dark shadows of abuse as undocumented immigrants,' Kennedy said.
The bill would strengthen border controls, hike penalties for businesses
using illegal immigrants, start a guest-worker program and evaluate
qualifications of would-be immigrants.
Bill opponent, Sen. David Vitter, R-La., faulted the bill for offering
'pure, unadulterated amnesty' to illegal immigrants. He said Americans
would be against the bill if they knew what it contained.
