Sen. Kennedy is starting a new campaign next week to push for a
guest-worker amnesty bill. I don't think it's an exaggeration to call this
Kennedy's declaration of war against the sovereign nation of the United
States.
According to the Washington Times, Kennedy's bill is being written by a
coalition of special interests that include the Essential Worker
Immigration Coalition, the Chamber of Commerce, the ACLU, the National
Immigration Law Center, La Raza, and the Service Employees International
Union.
We don't know the details of what is in the Kennedy proposal because he is
only letting special interests in on it. Kennedy's perversion of Democracy
is only allowed behind closed doors.
Lou Dobbs described the situation on 2/22/07:

The next day the Dobbs show was no more encouraging:
SYLVESTER: Well, the Senator's office, they are insisting that
they are not negotiating their immigration proposal in secret,
but when I asked them to release even draft details of the plan,
they would not make it public.
While we can't be sure exactly what will be in Kennedy's new bill, it's
probably safe to assume that it will be similar to the Secure America and
Orderly Immigration Act (S.1033) which was sponsored by Senators McCain
(R-AZ) and Kennedy (D-MA), or it might be a variant of the legislation
Kennedy recently tried to sneak into the minimum wage bill. Nicknamed the
McKennedy bill, in the first year up to 400,000 nonimmigrants will be
issued H-5 visas to work in the U.S. While the bill purports to be for
non-skilled workers, it also increases the number of visas that can be
issued for skilled white-collar workers. Yearly limits on the number of
visas will be determined by employer demand and can be increased by 20% a
year! H-5 visa holders will be put on track to get green cards so its a
de-facto amnesty.
The McKennedy bill almost renders H-1B a moot issue because it allows such
large numbers of workers into the U.S. H-1B doesn't go away in McKennedy --
it gets bigger and more bloated!
As the controversy heats up you are likely to hear lots of talk about
"comprehensive immigration reform", amnesty, securing our borders, etc. You
won't hear much about H-1B or the effects this will have on white collar
workers because high-tech companies like Microsoft want to keep their push
for increasing H-1B and employment based green cards out of the public
spotlight. Don't be blinded by the smokescreens!
The last several newsletters have featured some recent fraud cases in the
H-1B visa program. If fraud can't be controlled with the relatively small
number of visas in the current program why would anybody believe that the
fraud won't be exponentially worse when the number of visas is
exponentially increased?

Senate illegals bill near complete

Senators and lobbyists are putting the final touches on a comprehensive
immigration-reform bill that includes an easier citizenship path for
illegal aliens and weaker enforcement provisions than were in the highly
criticized legislation that the Senate approved last year. Sen. Edward M.
Kennedy, the Massachusetts Democrat who ardently supports citizenship
rights for illegals, will introduce the bill as early as next week,
according to Senate sources knowledgeable about the negotiations. If the
Senate Judiciary Committee can make quick work of the bill, it could be
ready for floor action in April.
Mr. Kennedy drafted this year's bill with help from Sen. John McCain,
Arizona Republican, and outside lobbyists. Mr. McCain and the outside
groups share Mr. Kennedy's support for increased immigration and leniency
for illegals already in the country. Among the most active participants
have been the Essential Worker Immigration Coalition (EWIC) and the U.S.
Chamber of Commerce. Both groups support giving current illegals a path to
citizenship and increasing the flow of foreign workers into the country.
"It's good for the country," EWIC immigration lawyer Laura Reiff said of
Mr. Kennedy's bill.
In particular, EWIC and the chamber have taken a leading role in drafting
the section of the bill dealing with work-site enforcement, Senate staffers
say. Lobbyists in both organizations have shuttled around Capitol Hill
drafts of those provisions, which are supposed to impose sanctions on
businesses that hire illegal aliens, according to internal e-mails obtained
by The Washington Times.
"That's putting the fox in charge of the henhouse," one Senate lawyer said
about the pro-business chamber's involvement in drafting the punishment of
employers.
One of those e-mails obtained by The Times invited Democratic immigration
staffers to a briefing in early January with "key stakeholders" to discuss
workplace-enforcement provisions. The invitation listed six such
"stakeholders," including the chamber and EWIC. The other groups attending
the meeting, according to the e-mail, were the American Civil Liberties
Union, the National Immigration Law Center, the National Council of La Raza
and the Service Employees International Union.
Not included in that meeting or any of the early meetings, according to
several Senate aides, were key Republican senators or their staff who
crossed the aisle last year to support "comprehensive" immigration reform
that most Republicans considered a form of amnesty.
"We have been held out of any discussions," said Sen. Sam Brownback, one of
those who supported last year's major immigration bill. "Our staffs have
asked to be involved, but they were kept out." Even Sen. Arlen Specter, the
Pennsylvania Republican who as chairman of the Judiciary Committee last
year ushered the immigration bill through the Senate, has been left out of
the process of drafting the bill.
Mr. Specter said yesterday that he and Mr. Kennedy have discussed the need
to get a bill done this year but not any details. Mr. Specter has twice
complained to Mr. Kennedy, most recently at a meeting last week, that the
Republican senator's staff had been left out of negotiations.
"I raised the issue again, and a Kennedy staffer said there was nothing in
writing" as legislation, he said. "Neither my staff nor I have seen any
draft." Last week, aides and Republicans said, Mr. Specter, Mr. Brownback
and others were invited to a meeting where they got their first briefing on
the nearly completed bill. Other Republicans invited included Sens. Lindsey
Graham of South Carolina, Chuck Hagel of Nebraska and Mel Martinez of
Florida. Laura Capps, a spokeswoman for Mr. Kennedy, said he has been
working with "many senators and members of Congress to draft the new bill."
"The bipartisan coalition behind the bill remains strong and intact."
The one Republican who all agree has been part of the negotiations from the
start is Mr. McCain, who is running for his party's presidential
nomination. This worries Republicans who say that Mr. McCain is the last
Republican they want representing their interests in negotiations with Mr.
Kennedy over immigration legislation.
Mr. McCain and Mr. Kennedy have long embraced the same goal of giving
illegal aliens a direct path to U.S. citizenship despite having broken laws
to get here in the first place. Both men also denounce the view held by
most Republicans that the federal government should first secure the border
with Mexico and begin enforcing current laws before addressing other
immigration issues such as what to do with the more than 10 million to 12
million aliens already here. Who has been in and out of negotiations this
year signals to Republicans that Mr. Kennedy will introduce a bill that
more resembles the original McCain-Kennedy bill than the compromise that
was ultimately approved last year.
As much as conservatives dislike last year's compromise bill, they consider
it some improvement over the original bill because it lowered the number of
new foreign workers permitted into the country each year and slightly
narrowed the pool of illegals who would be granted "amnesty."
"If it's back to the old version without the changes we made last year, I
don't think I could support that," Mr. Brownback said.
Ms. Capps said she expects Mr. Kennedy to introduce his bill "in the next
few weeks." Majority Leader Harry Reid, Nevada Democrat, is "committed to
getting something done this year," his spokesman said.

DOBBS: Corporate lobbyists and special interest groups are helping Senator
Edward Kennedy write legislation that would give millions of illegal aliens
amnesty. The legislative work is being done in secret.
Taxpayers who will ultimately have to pay for that legislation for amnesty
will not have a voice. But guess who does? You thought this was a
Democratic Congress and would be unlike the Republican Congress? Well, get
ready.
The Chamber of Commerce and groups like it have been allowed to hijack a
large part of the process and even write part of the legislation.
Lisa Sylvester reports.

LISA SYLVESTER, CNN CORRESPONDENT (voice over): Senator Ted Kennedy and his
staff have been quiet on the details of their new immigration proposal.
It's by invitation only.
Even moderate Republicans like Senator Arlen Specter have not been offered
a seat at the table. But the Chamber of Commerce and other special
interests are having a hand in offering the legislation.
One Republican Hill staffer complained, "The Chamber has seen more than the
senators when it comes to the actual writing on paper."
ROY BECK, NUMBERSUSA: Senator Kennedy has been inviting the stakeholders of
this bill to come in. So that's the Chamber of Commerce. And it's the
National Council of La Raza, and it's the immigration attorneys. Basically,
the stakeholders are people who make money or gain power off of it. But how
about the American people?
SYLVESTER: Kennedy's new bill will be introduced as early as next week. It
may closely parallel legislation he offered last year with Senator John
McCain. That was more generous to illegal aliens than anything that passed
the House or Senate.
Under the previous proposal, all illegal aliens would be allowed to stay in
the United States. After six years, they could pay a $1,000 fine and apply
for a green card. A new guest worker program would be established, and most
companies would not be required to check work eligibility of future
workers.
If the new immigration plan reflects the old, it could put off swing
lawmakers.
REP. BRIAN BILBRAY (R), CALIFORNIA: You're seeing Republican senators who
had supported the concept before backing away off on this, because they
went home in December and actually got an earful form their constituents.
And you're seeing a lot of members of the Senate that had supported Kennedy
before are not going to buy off on this now.

SYLVESTER: The Senate picks up the debate next Wednesday, when secretaries
Michael Chertoff and Carlos Gutierrez testify before the Judiciary
Committee.
A Democratic staffer said they want the Bush administration to go on
record. And they signal they expect the president to use more of his
political capital to get an amnesty bill through Congress this year -- Lou.
DOBBS: This president has political capital to use?
The other part of this is, what is the difference between this Democratic
Congress and the Republican Congress? Putting the Chamber of Commerce in
the position of writing legislation, putting all of these interest groups
at the table, writing legislation, there's one stakeholder left out of
this, Lisa, and it's pretty clear -- the American middle class, the
American citizen.
What in the world is the Democratic leadership doing?
SYLVESTER: This is almost identical to what we saw last year. And despite
the election in which the people spoke loudly and clearly, we are seeing
more of the same when it comes to letting special interests dictate that
what ultimately is the policy on immigration in this country -- Lou.
DOBBS: When I watch this, I'll tell you, Lisa, it makes me proud to be an
independent populist and to -- I mean, as we talk about, and have talked
about for some time, these two parties have become just opposite wings of
the same bird. And we know who is getting the bird in this country right
now.

Lisa, I understand Senator Ted Kennedy took issue with your report last
night, talking about working with the Chamber of Commerce and business
groups. Actually, the Chamber of Commerce being given the opportunity to
write that legislation in secret. What's his complaint?
SYLVESTER: Well, the Senator's office, they are insisting that they are not
negotiating their immigration proposal in secret, but when I asked them to
release even draft details of the plan, they would not make it public.
And the Senator actually put out a statement today saying, "We expect to
have broad support from Democrats and Republicans, labor and business
leaders, the religious community, immigration advocates. Everyone has had
and will have an opportunity to be heard in the process."
Obviously, these are the open-border folks. Except who's not having a say,
Lou, are the key Senators. There are members even of the judiciary
committee, including the ranking Republican, Arlen Specter, is not reached
out to by those -- those lawmakers that are drafting this legislation.
DOBBS: So the complaint was with our saying that -- basically allowing the
Chamber of Commerce to help the good Senator write this legislation in
secret. It wasn't a complaint about the fact e chamber's right writing part
of this legislation, at least part of it, but, rather, the idea that we
said it was secret, but they won't give us any details.
SYLVESTER: They won't to give us any details, and as for the chamber
writing this, they say the chamber is not actually writing it. But at the
same time that they're having a lot of input. So we're splitting hairs
here.
DOBBS: This is the new Democratic Congress, right?
SYLVESTER: Yes, it is, Lou.
DOBBS: Why does it sound so much like the old Republican Congress? Isn't it
amazing?
It shows you the clout of big business on Capitol Hill. DOBBS: It does. And
it also shows you the -- unfortunately, the abject lack of character on the
part of our Senators and congressmen. Too many of them seem to be concerned
about representing the American citizens who put them in office and who
keep them there, with or without bad judgment, in doing so.

Goodbye to the American Dream

Senators Ted Kennedy and John McCain have created an unholy alliance to
force a Guest Worker Amnesty bill through the Senate that will give United
States citizenship to illegal aliens and create a bureaucratic nightmare
that will endanger national security.
Those who support this proposal have much to gain. This is all about
undercutting wages for United States citizens and resident aliens. This is
about providing immigration lawyers with a potentially limitless supply of
clients. This is about providing political leverage to various advocacy
groups who favor open borders.
The losers in this campaign are the many Americans who are hanging on to
their share of the "American Dream," struggling to make ends meet.
The legislation, according to an article titled "Senate illegals bill near
complete" in the Washington Times Thursday, will not just provide United
States citizenship for millions of illegal aliens who are in the country
now -- not to mention those who will charge the borders of our nation and
claim to have been present in the United States for the required period of
time -- it will open the floodgates for many more aliens to enter the
United States legally as well.
Labor, just like any other commodity, is governed in the marketplace by the
laws of supply and demand. With a virtually limitless supply, the price of
labor will plummet, I fear to the point at which workers in the United
States and workers in Mexico will be making comparable salaries. It is not
that the wages for Mexicans will rise in Mexico; it is that the wages of
our citizens will fall precipitously.
Additionally, our immigration system will be utterly incapable of dealing
with the massive flood of new aliens - it cant even handle the ones we
have now. At present many Government Accountability Office and Office of
Inspector General reports have thoroughly documented the rampant fraud
crisis at US Customs and Immigration Services, the division of the
Department of Homeland Security that adjudicates applications for
immigration benefits, including the conferring of resident alien status and
naturalization, affording them with the ultimate "keys to the kingdom:"
United States citizenship. This agency, which has proven itself to be
incompetent time and time again, is the same agency that will administer
this new program.
The terrorists who attacked our nation on September 11, 2001, along with
other terrorists who have operated within our country over the last couple
of decades, have often entered our nation and hidden among us by availing
themselves of opportunities to game the immigration system. This program
that is favored by Senators Kennedy and McCain would make it so easy for
terrorists and criminals to exploit vulnerabilities in the system that
gaming the system will be like taking candy from a comatose baby.
The bill will eliminate the debates raging across the United States about
the way in which local governments can enforce segments of the immigration
law. Virtually every illegal alien present in the United States will
ultimately be granted lawful immigration status and be put on the path to
United States citizenship. They will also acquire the right to bring to
America their family members as well! As United States citizens, they can
petition the government to provide resident alien status to their parents,
brothers and sisters (even if they have a dozen siblings) and their spouses
and children.
If the legislation that emerges from the Senate is comparable to the
travesty of the bill passed in the last session, S. 2611, illegal aliens
will also be entitled to receive Social Security benefits even if they
committed identity theft and worked illegally under another person's Social
Security Number. It would not matter whether mayors and other local town
officials had declared their municipalities to be "sanctuary cities" for
illegal aliens because the United States of America would become one big
"Sanctuary Country."
Meanwhile, the President has been cheering on these politicians, doing
everything he can to erase our nation's borders. The only way this train
wreck can be prevented is for the House of Representatives to refuse to go
along with the program.
It would appear that if the President and Senators Kennedy and McCain had
their way, the only aliens to the United States on the planet earth would
be those who are seen arriving in flying saucers. They would become like
the characters portrayed by actors Will Smith and Tommy Lee Jones in the
movie, "Men in Black." Of course, that movie was good, clean
entertainment. What these politicians are preparing is an unmitigated
disaster.
As I have said before, those who protected and saved our nation during the
dark days of the Second World War came to be known as the "Greatest
Generation." Those of us who inhabit the United States today may be
remembered as the "Last Generation!"
On September 1 of last year I was invited to travel to Dubuque, Iowa to
testify at a field hearing called by Rep. F. James Sensenbrenner, then
Chairman of the House Judiciary Committee. The hearing was entitled, "Is
the Reid-Kennedy Bill a Repeat of the Failed Amnesty of 1986?" Joining me
at the witness table were three other witnesses including Senator Charles
Grassley. His appearance was particularly noteworthy because he had been
an advocate for the abysmal Amnesty of 1986. You can read the transcript

If ever there was a time for the citizens of our nation to be heard, the
time is NOW!
If this bill is allowed to become the law of the land, there will be no
going back!
