Spring graduation is close at hand, and that means graduates will soon
march in their flowing robes at commencement ceremonies throughout the
nation. Graduation might be a time of pride and joy - and optimism
about the future, but the euphoria won't last long for many of the
American kids who chose to get technical degrees. These college kids
might have impressive sounding diplomas but none of that will matter
when they have to compete in a job market where the rules are stacked
against them. Companies such as the ones featured below are looking
exclusively for foreign students who graduated from our universities.
College kids that are unfortunate to be born in the USA will have to be
satisfied working at Wal-Mart and Fry's Electronics while their foreign
classmates will get preferential treatment for high-tech jobs. These
ads are very blatant in their desire to exclude American students but
don't think major employers are any different in their hiring
practices; they are just more subtle to avoid legal hassles.
One of the keywords to look for in the 16 job ads featured below is
"OPT", which stands for "Optional Practical Training". OPT gives
students on F-1 visas a temporary authorization to work in the U.S.
while going to our universities. OPTs are granted by the U.S.
Citizenship and Immigration Service (USCIS) - formerly known as the
Immigration and Naturalization Service or INS. OPTs don't need approval
or review by the Dept. of Labor even though these students are working
in jobs that are in most cases identical to those taken by H-1B.
So in summary, here is what these companies are up to in simple terms.
They hire foreign students who are going to universities with F-1 visas
to work as interns until they graduate. Upon graduation many of the
companies convert the F-1 visa into an H-1B. American students or
unemployed techies are never even considered for these jobs. For a good
example of this look at Job Ad #15.
Wanted Citizens/H1 visa holders/Students on OPT who have
atleast 1 year of OPT remaining for cross training on
CRM/Datawarehousing at our Bay area office.
The only people that will meet the requirement of having one year of
training at their Bay area office are foreign students on OPTs. That's
because OPTs are good for - ONE YEAR! I highly doubt there are many
citizens that have worked at their Bay area office for a year, and keep
in mind that anything over a year means applicants are overqualified,
and anything under and applicants don't have enough experience.
Ad #11 actually lists F1, OPT, H1B, and "fresh graduate" as a skill
requirement. Since when did being a "fresh graduate" become a job
skill? This is nothing but thinly disguised age and nationality
discrimination. The title of the job says more than I could:

Ad #1 doesn't beat around the bush; the job title is "H1B". For those
Americans that don't get the hint the job description says "This is
ONLY for THOSE WHO NEED H1B SPONSORER". The only skills listed are for
J2EE or .NET which is hardly what we consider to be specialized skills.
Those are quite generic skills that many college grads wouldn't have
until they have worked in industry for awhile
Ad #2 explicitly says that they want MS grads in Computer Science with
current OPTs or who are getting into OPT status. This single
requirement eliminates all U.S. citizens from consideration, and its
very clear that they don't want anyone older than college aged. Many of
the ads below offer their OPTs free training. I'm sure most of you that
have applied for jobs are told that you must "hit the road running" and
if you need training it will have to be paid for out of your own pocket
before you will be considered for being hired.
QUESTION TO PONDER: Why do foreign students get free training if they
are so damned smart and so well educated?
Ad #7 is even more blatant on the age discrimination, and they leave no
doubt that only the only ones that need apply are Green Card holders,
H-1Bs, and F-1s with OPT.

These job ad newsletters tend to raise questions especially from the
newer subscribers about what can be done to stop these companies from
discriminating against American workers. Unfortunately not much can be
done to deter them because "national origin" is not considered a
protected class like gender, race, age, etc. Complaints can be filed to
the government to ask them to contact employers to change the wording
of the ads, and that's a worthwhile endeavor even though it's more
symbolic that substantive. Employers are going to continue this type of
nationality based discrimintion as long as they have a supply of cheap
foreign labor and it doesn't matter what their job ads say.
