I received this correction from Norman Matloff on the 7th year
extension,
and he is right. This extension is not a loophole, it is the letter of
the
law.

"This is not exactly a loophole, and certainly not something that
Congress hid. It was a major concession to ISN, in the 2000
legislation. ISN had complained that many of its members were in the
6th year of their H-1B visa and yet still had not green card in sight.
So Congress put in a provision to help them.

And if I am not mistaken, it is not just for the 7th year. The rule can
be applied indefinitely, I believe.

Of course, industry loves this. Infinite indentured servitude."

It didn't take me long to find out that Norm is right about ISN, they
lobbied for the extension and did quite a bit of schmoozing with Eshoo.

The new law allows an H-1B to exceed the 6-year time limit on the visa,
if a
greencard application is pending. From the H-1Bs' point of view, this of
course is preferable to having to leave the U.S., but from the
employers'
perspective, it means that the period of indentured servitude can be
extended even longer.
